Hartono & Others v MPI and Sajo Oyang Corporation


On 9 August 2017, the Supreme Court granted former crew members of Oyang 70 and Oyang 75 leave to appeal in respect of their claim for unpaid wages.  Oyang 70 sank on 18 August 2010, 740 kilometres east of Otago killing six men.

The Supreme Court will consider if the appellants have an interest in a sister ship (Oyang 77) forfeited to the Crown for fisheries offences and whether they can apply under S 256 Fisheries Act 1996 for relief.

The Ministry of Primary Industries and Sajo Oyang Corporation are opposing the crew’s application.
