The interface between the Health and Safety at Work Act 2015 and a vessel operator’s obligations under the Maritime Transport Act 1994 is complex and poorly understood.

Investigations after accidents or incidents are complex and fast moving, encompassing multiple interactions with different regulatory bodies, including Maritime New Zealand, WorkSafe, the Transport Accident Investigation Commission, and the New Zealand Police.

The Dawson & Associates team have extensive experience at dealing with the legal aspects of maritime health and safety.  We have a network of experienced health and safety professionals that we deploy in the event of an incident, to assist us manage these investigations.

Where an investigation results in a prosecution, we have significant experience in managing litigation, and have an established network of experienced barristers in New Zealand and the South Pacific.

We have represented many clients in high-profile matters involving accidents, and prosecutions, defending clients under the new Health and Safety at Work Act 2015, and its predecessor the Health and Safety in Employment Act 1992.

We are also regular presenters on maritime health and safety issues to the Marine Transport Association, the New Zealand Maritime Pilots Association and the Federation of Commercial Fishermen.
